Please read these Terms of Service ("Terms") carefully before using Prompt Framework Studio (the "Service") operated by Simplicate AI, LLC ("we," "us," or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Prompt Framework Studio is a web application that provides:

• Tools for creating structured prompts using various LLM prompting frameworks
• Framework-specific guided forms (Tree-of-Thought, Chain-of-Thought, Self-Consistency, Role-Based, and Reflection)
• Real-time prompt preview and generation
• Prompt library for saving and managing prompts
• User authentication and account management
• Two service tiers: Free and Premium

3. User Accounts

3.1 Registration

To use certain features, you must register for an account by providing:

• A valid email address
• A secure password

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

3.2 Account Security

You agree to:

• Provide accurate and complete registration information
• Keep your account information up to date
• Not share your account credentials with others
• Not create multiple accounts for the same person
• Not create accounts using automated means

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• Your account has been inactive for an extended period
• Required by law or legal process

You may delete your account at any time through the account settings.

4. Service Tiers

4.1 Free Tier

The Free Tier includes:

• Access to all prompting frameworks
• Unlimited prompt generation
• Save up to 5 prompts
• Standard support

4.2 Premium Tier

The Premium Tier includes:

• All Free Tier features
• Unlimited saved prompts
• Export prompts as text files
• Priority support
• Early access to new features

5. Acceptable Use Policy

You agree NOT to:

5.1 Prohibited Content

• Generate prompts that promote illegal activities
• Create content that is hateful, discriminatory, or harassing
• Produce prompts designed to exploit, harm, or deceive others
• Generate sexually explicit or violent content involving minors
• Create prompts that violate intellectual property rights

5.2 Prohibited Activities

• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with or disrupt the Service or servers
• Use automated scripts or bots to access the Service
• Reverse engineer, decompile, or disassemble the Service
• Circumvent rate limits or security measures
• Scrape, crawl, or harvest data from the Service
• Resell or redistribute the Service without authorization

5.3 Rate Limiting

We implement rate limiting to ensure fair use:

• Authentication endpoints: 5 requests per 5 minutes
• Other endpoints may have additional limits

Excessive use may result in temporary or permanent suspension.

6. Intellectual Property

6.1 Service Ownership

The Service, including all content, features, functionality, software, and design, is owned by us and protected by copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain ownership of prompts you create using the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive, royalty-free license to:

• Store and display your User Content as necessary to provide the Service
• Back up your User Content for data protection purposes
• Process your User Content as described in our Privacy Policy

6.3 Feedback

If you provide feedback, suggestions, or ideas about the Service, we may use them without any obligation to you.

7. Premium Subscription Terms

7.1 Billing

• Premium subscriptions are billed [monthly/annually]
• Payments are processed securely through [payment processor]
• All fees are in [USD] and non-refundable except as required by law

7.2 Automatic Renewal

Premium subscriptions automatically renew unless cancelled before the renewal date. You can cancel anytime through your account settings.

7.3 Refunds

Refunds are provided at our discretion. To request a refund, contact us at pfs-support@simplicate.ai within 30 days of purchase.

7.4 Changes to Pricing

We reserve the right to change Premium pricing with 30 days' notice. Changes will not affect your current billing cycle.

8. Service Modifications and Availability

8.1 Modifications

We reserve the right to:

• Modify or discontinue the Service (or any part) with or without notice
• Update features, frameworks, and functionality
• Change Free and Premium tier features

We will provide reasonable notice for material changes.

8.2 Availability

We strive to maintain high availability but do not guarantee:

• Uninterrupted or error-free Service
• That defects will be corrected immediately
• That the Service is free from viruses or harmful components

We may perform scheduled maintenance with advance notice.

9. Disclaimers

9.1 AI-Generated Content

The Service provides tools for creating prompts for use with Large Language Models (LLMs). We do not:

• Guarantee the quality or effectiveness of generated prompts
• Control how you use the prompts or what output LLMs produce
• Take responsibility for content generated by third-party LLMs

9.2 "AS IS" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, DATA, USE, OR GOODWILL
• SERVICE INTERRUPTIONS OR DATA LOSS
• THIRD-PARTY ACTIONS OR CONTENT

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

12. Third-Party Services

The Service may contain links to third-party websites or services. We are not responsible for:

• The content or practices of third-party services
• Any transactions between you and third parties
• The privacy policies of third-party services

13. Export Controls

You agree to comply with all export and re-export restrictions applicable to the Service and technology.

14. Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law provisions.

14.2 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in the State of Georgia, except for:

• Claims in small claims court
• Injunctive or equitable relief
• Intellectual property disputes

14.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or representative proceedings.

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Service.

15.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

15.3 Waiver

Failure to enforce any provision does not waive our right to enforce it later.

15.4 Assignment

You may not assign these Terms without our consent. We may assign these Terms to any successor or affiliate.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

16. Children's Use

The Service is not intended for users under 13 years of age. If you are under 18, you must have parental consent to use the Service.
